Legal overview

Legal overview

Ghana has a dual regulatory structure. The Gaming Commission licenses casinos, sports betting, online casinos, remote interactive games and other games of chance under the Gaming Act, 2006 (Act 721), while National Lotto is excluded from that Act and governed by the National Lotto Act, 2006 (Act 722) under the National Lottery Authority. A gaming operator must be a limited liability company, satisfy Ghanaian ownership and financial conditions and hold a licence for the exact game. Lottery activity must be conducted by the NLA or through an NLA-authorised marketing, private-operator or collaboration arrangement.

Regulatory developments

Act 721 and Act 722 remain the principal accessible statutes. The Gaming Commission publishes a current 2026 operator register by product and expiry date, and the NLA publishes current authorised collaborators and private operators. Tax treatment changed in 2025, including removal of the 10% withholding tax on player winnings, but taxation neither creates nor extends a gaming licence. Any future Gaming Act amendment or new legislative instrument should be monitored.

Responsible gambling

Responsible gambling

The operational standard is 18+. The Gaming Commission requires gambling advertisements to state 18+, warn that gambling is addictive and promote responsible play; advertisements require prior approval and may not imply assured wins or use celebrities. The Commission also identifies KYC, age verification, bet limits and self-exclusion as operator controls. NLA materials likewise display 18+ and responsible-play notices. Country content should warn against borrowing, chasing losses and treating gambling as investment income.

How we review

Rules by gambling category

We separate casinos, sports betting, sports predictions and lotteries because the rules and authorised channels may differ.

Regulated

Casino

Current position

Casino gambling is a licensed market in Ghana, but approval attaches to a specific company, product and period. The Gaming Commission’s public register distinguishes physical casinos, online casinos and remote interactive games, so a familiar brand or one valid entry cannot be used to infer permission for every channel. Before a rating or outbound link is enabled, match the trade name to its legal operator, confirm the operation type and check both issue and expiry dates. Marketing content must also be approved by the Commission and cannot promise winnings. Reviews should explain game rules, withdrawal conditions, complaints and responsible-gambling controls rather than presenting bonuses as guaranteed value.

Licensing

Land-based and online casinos require a Gaming Commission licence for the specified operation. The applicant must be a qualifying limited liability company and meet ownership, capital, integrity and tax conditions.

Online availability

Online casino and remote interactive games are licensed categories shown separately in the Commission register. A retail casino or sports-betting licence does not cover them.

Advertising and commercial links

Commission approval is required. Ads must identify the regulator, use 18+ and addiction warnings, avoid assured-win claims and celebrities, and run only while the relevant licence remains valid.

Responsible gambling

Apply 18+ identity verification, deposit and loss limits, session reminders, cooling-off and self-exclusion. Include addiction warnings and help information, prohibit credit and loss-chasing messages and never describe casino play as income or investment.

Regulated

Sports betting

Current position

Ghanaian sports-betting coverage can include licensed operators only after a live register check. The official list records sports betting, online sports betting and combined online and land-based permissions as distinct operation types, often with annual expiry. A page should therefore store the verified category and date instead of treating brand recognition as evidence. Predictions and match analysis must remain separate from the act of accepting a stake. Rankings should disclose methodology and commercial relationships, describe complaints and withdrawal rules, and remove links automatically when a licence expires, is suspended or no longer covers the displayed channel.

Licensing

Sports betting requires a licence from the Gaming Commission under Act 721. Online, retail and combined permissions must be checked against the operation type in the current register.

Online availability

The Commission actively lists online sports-betting operators. An overseas licence, Ghana-accessible website or payment option does not substitute for a current Ghanaian entry.

Advertising and commercial links

All promotions require Commission vetting, responsible-gambling and 18+ warnings, regulator identification and substantiated claims; assured wins and celebrity advertising are prohibited.

Responsible gambling

Enforce 18+, KYC, bet and deposit limits, breaks and self-exclusion. Show addiction and financial-risk warnings, discourage borrowing and loss chasing and make clear that betting is entertainment, not a reliable income source.

Restricted

Predictions

Current position

Predictions may be published for Ghana as evidence-based editorial content, provided the publisher does not accept wagers, control player money or distribute a prize determined by chance. Selling analysis does not make a result certain, and converting a forecast into a pooled contest, betting interface or operator funnel can bring it within Act 721. Each article should identify its data period, assumptions, uncertainty and correction policy. Commercial relationships must be visible, while language about guaranteed outcomes, fixed matches or recovering losses should be excluded. Any attached betting link requires a current, product-specific Ghanaian licence and advertising approval.

Licensing

Independent sports forecasts are editorial when they neither accept stakes nor award chance-based prizes. A monetised prediction product that becomes a game of chance requires Gaming Commission review and licensing.

Online availability

Do not embed deposits, bet execution or unlicensed operator referrals into an analysis service. The underlying operator and exact online product must appear in the current Commission register.

Advertising and commercial links

Publish methods and conflicts, avoid guaranteed-win or recovery claims, and apply the Commission advertising controls whenever content promotes a gambling operator.

Responsible gambling

State that forecasts are uncertain and cannot guarantee profit. Use 18+ controls for gambling-linked content, reject loss-recovery claims, encourage fixed entertainment budgets and provide breaks, self-exclusion and support guidance.

Regulated

Lotteries

Current position

Lottery regulation in Ghana sits outside the Gaming Commission system. Act 722 gives the National Lottery Authority control of National Lotto and provides the framework for licensed marketing companies and approved private operators or collaborators. This means a lottery page should never use a casino or betting licence as evidence. Before listing a product, verify the organiser and sales partner with the NLA, record the authorised game and channel and confirm current status. Reviews should give the ticket price, draw schedule, prize rules, claim deadline and official complaints route. Foreign ticket agents and unlisted sellers should receive no transactional link.

Licensing

National Lotto is conducted and regulated by the NLA. Lottery marketing companies, private lotto operators and collaborators require the appropriate NLA authority; unauthorised operation is an offence.

Online availability

Digital sale or technology participation must fall within an NLA-authorised product and collaborator or operator arrangement. A foreign lottery or reseller is not authorised merely because it accepts Ghanaian customers.

Advertising and commercial links

Verify the organiser and seller against current NLA information, display 18+ and responsible-play warnings, and publish exact draw, ticket and claim terms.

Responsible gambling

Restrict play to adults aged 18 or over, present tickets as random discretionary spending, disclose price and odds, discourage borrowing and repeated purchases after losses and provide spending controls, scam warnings and support information.
